Conservation Board Amends Two Enforcement Orders

Abington Conservation Commission advances Helm Street wetlands case, amends two other enforcement orders. Chair Lynn Mullen presided as newly retained attorney Matt Watsky, representing property owner Mike Newton, pressed the board on how it defines "bordering land subject to flooding" at 22 Helm Street, citing a FEMA elevation of 165.6 feet. Conservation Agent Nick Jinx read a MassDEP email showing Newton's certificate-of-compliance request was denied over undisclosed site alterations.

The commission voted unanimously to amend enforcement orders at 225 Brockton Avenue, setting a December 1 compliance-plan deadline and restricting parking to paved surfaces, and at 22 Helm Street, requiring a site visit by October 13, an updated plan by November 3 and an appearance November 10. Abutter William Creighton said the site's 2008 and 2026 wetland delineations differ "very different" and questioned stacked boulders found near test pits.
